INFORMATION TEXT ON THE PROTECTION OF PERSONAL DATA

In accordance with the Personal Data Protection Law No. 6698 (“KVKK”), your personal data will be processed by our Company, acting as the Data Controller, for business purposes, within the framework outlined below. In this context, your personal data will be used, recorded, stored, updated, transferred, and/or classified as necessary. Our Company, in compliance with the Law and Regulations established to protect individuals' fundamental rights and freedoms, particularly the privacy of private life, takes all technical and administrative measures to ensure the prevention of unlawful processing, unauthorized access, and the protection of your personal data.

The target audience of this text includes all individuals whose personal data is processed by our Company, excluding our employees and job applicants.

DEFINITIONS

Personal Data: Any information relating to an identified or identifiable natural person.

Processing of Personal Data: Any operation performed on personal data, whether wholly or partly by automatic means or by non-automatic means, provided that it is part of a data recording system. This includes obtaining, recording, storing, preserving, modifying, rearranging, disclosing, transferring, taking over, making available, classifying, or preventing the use of personal data.

Data Controller: The natural or legal person responsible for determining the purposes and means of processing personal data and for establishing and managing the data recording system. In this context, the data controller is TAN-EKS OTOMOTIV VE DIS TICARET LTD. STI., located at H. Rıfat Paşa, Elektrokent B Blok, Perpa Ticaret Merkezi D:902-903-904, 34384 Şişli/İstanbul.

Explicit Consent: Consent that is based on information and is freely given regarding a specific subject.

Board: Refers to the Personal Data Protection Board.

As a data controller, the personal data processed includes, but is not limited to, the following: Name, surname, Turkish ID number, address, phone number, email address, signature, physical location/security footage, call center/service quality voice recordings, bank account number, cookie records, etc.

Purposes and Legal Grounds for Processing Personal Data;

Your personal data, shared by you, will be processed for the following purposes, among others;

  • To enable you and/or the institutions and organizations you represent to benefit from the products and services offered by our Company, To determine and implement our Company’s commercial and business strategies, including marketing activities, business development, and planning,
  • To carry out administrative operations related to communication activities conducted by our Company,
  • To ensure physical security and supervision of the locations used by our Company,
  • To establish relationships with business partners/customers/suppliers (their representatives or employees),
  • To fulfill contractual obligations and financial reconciliations related to products and services offered in collaboration with our business partners, suppliers, or other third parties,
  • To manage our Company’s human resources policies,
  • To process data when contacting our call center or using our website,
  • To participate in training, seminars, or events organized by our Company.

Methods of Collecting and Storing Personal Data;

The personal data you share with our Company may be collected through automated or non-automated methods via offices, branches, call centers, websites, social media platforms, mobile applications, and similar channels, either verbally, in writing, or electronically. Your personal data will be stored in electronic and/or physical environments. Our Company implements necessary technical and administrative measures to prevent unauthorized access, manipulation, loss, or damage to your personal data in the environments where they are stored.

Your personal data will be processed in compliance with the purposes and scope communicated to you and will be stored for the legally prescribed retention period, or, if no such period is specified, for as long as required for the processing purpose. Once this period ends, your personal data will be removed from our Company’s data streams through deletion, destruction, or anonymization methods.

Transfer of Personal Data;

Your personal data may be transferred to the following parties within the scope of the Laws and other legislation and for the purposes described below;

  • to TAN-EKS OTOMOTIV VE DIS TICARET LTD. STI.,
  • To our authorized companies and representatives operating on behalf of our Company,
  • Regulatory and supervisory authorities, public institutions or organizations that are expressly authorized to request your personal data under their laws,
  • Within the scope of the specified purposes, business partnerships, supplier and contractor companies, banks, credit risk and financial institutions and other real or legal persons,
  • May be transferred to tax and similar consultants, persons required for legal follow-up processes, institutions and organizations, and third parties from whom we receive consultancy, including auditors, and, without limitation, to business partners, third parties from whom services are received, authorized persons and organizations for the above-mentioned purposes, both domestically and abroad.

Your Rights Under Article 11 of the KVKK:

By applying to our Company, you have the right to:

  1. Learn whether your personal data is being processed,
  2. Request information if your data has been processed,
  3. Learn the purpose of processing your data and whether it is being used appropriately for its purpose,
  4. Know the third parties, both domestically and abroad, to whom your personal data is transferred,
  5. Request the correction of any incomplete or incorrect data,
  6. Request the deletion or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK,
  7. Request that the third parties to whom your data has been transferred be notified of the actions taken in accordance with paragraphs (5) and (6),
  8. Object to any adverse outcome arising from the analysis of your data through exclusively automated systems,
  9. Request compensation if you incur damages due to the unlawful processing of your personal data.

In accordance with Article 13, Paragraph 1 of the KVKK, you may submit your request to exercise the above rights either in writing or through other methods as determined by the Personal Data Protection Board.

To exercise these rights, you can personally deliver your request with necessary identification information, send it via a notary, use other methods determined by the Personal Data Protection Board, or submit it with a secure electronic signature to info@taneks.com.
